一、课程设计目的和意义
本课程是工程管理专业一门主要专业课。它着重讲述了与建设工程合同管理相关的合同管理法律知识、合同法律制度、合同管理的基本原理和应用方法，工程建设中主要合同的基本内容、要求以及国际通用FIDIC土木工程施工合同条件的规定。建设工程合同管理是工程建设发展和科学管理的重要环节，是提高工程建设社会效益和经济效益的法律保障和重要工具。课程设计环节主要是要求学生应用合同管理的知识解决实际问题，提高动手能力。理论联系实际更好的吸收所学的知识。
二、任务安排
1、FIDIC合同条件拓展学习
FIDIC是国际咨询工程师联合会Fédération Internationale des Ingénieurs-Conseils的法文缩写，中文音译为“菲迪克”。有人称FIDIC合同是国际承包工程的“圣经”。可以说，FIDIC合同是集工业发达国家土木工程建筑业上百年的经验，把工程技术、法律、经济和管理科学等有机结合起来的一个合同条件。
要求：查找资料，阅读：FIDIC合同条件之一，《施工合同条件》(Conditions of Contract for Works of Construction)（红皮书）；国外的施工合同管理著作；英文期刊上的论文。三者选择其一精读，并摘抄其中某一部分（1000words以上的文章）进行翻译。
注：注明文章来源，FIDIC写明摘自哪一部分；著作应标明作者，出版时间，出版社，摘自页码；期刊应标明刊名、刊号、期（卷）数及文章名、作者、页码。
翻译标准应尽可能采用专业语言。
在译文后列出10个你学习到的英文专业词汇。
2、尝试分析合同管理中的前沿问题
通过到图书馆查阅或在网络上获得的资料尝试分析一些前沿问题。
以下按班级的学号排列给出了一些问题：
大型项目的质量控制体系
大型工程的进度控制体系
总承包企业组织结构与项目组织结构的创新
合同中权力、义务与责任的划分，风险的防范体系。
怎样从合同管理角度发掘总承包企业的核心竞争力？
总承包企业承揽国际工程的途径和模式。
Fidic条件下国际工程的付款方式。
PIP（project information portal项目信息门户）技术中的合同管理又怎样的新发展。
从人力资源角度考虑合同管理人员与项目其他管理人员的交流与协作。 项目索赔中心建立的必要性和可行性
索赔事件发生后的处理需要各职能部门的配合，怎样建立协调机制。
能否将国际上工程师为主项目管理模式引入到我国的项目监理制度中。 要求：按学号选择一个你感兴趣的问题，或不在范围内而自己另外拟定一个问题（与给出的类似），广泛的查阅资料，总结出现阶段学界对于你选定的问题已经进行的哪些研究。
注：在图书馆及其论文数据库中查阅相关论文，选出你认为对于问题的研究最为深入的期刊论文3篇，并注明以下内容：标题，作者，期刊名，关键词，主要内容，论证的方法，模型的选择，是否有实证研究，结论如何。
最后，根据以上内容阐述你对此问题的观点，语言精炼简洁，内容具体明确。字数严格控制在500字。

17. Risk and Responsibility
17.1Indemnities
The Contractor shall indemnify and hold harmless the Employer, the Employer′s Personnel, and their respective agents, against and from all claims, damages, losses and expenses (including legal fees and expenses) in respect of:
(a) bodily injury, sickness, disease or death, of any person whatsoever arising
out of or in the course of or by reason of the Contractor′s design (if any), the execution and completion of the Works and the remedying of any defects, unless attributable to any negligence, wilful act or breach of the Contract by the Employer, the Employer′s Personnel, or any of their respective agents, and
(b) damage to or loss of any property, real or personal (other than the Works), to the extent that such damage or loss:

(ii) is attributable to any negligence, wilful act or breach of the Contract by the Contractor, the Contractor′s Personnel, their respective agents, or anyone directly or indirectly employed by any of them.
The Employer shall indemnify and hold harmless the Contractor, the Contractor′s Personnel, and their respective agents, against and from all claims, damages, losses and expenses (including legal fees and expenses) in respect of (1) bodily injury, sickness, disease or death, which is attributable to any negligence, wilful act or breach of the Contract by the Employer, the Employer′s Personnel, or any of their respective agents, and (2) the matters for which liability may be excluded from insurance cover, as described in sub-paragraphs (d)(i), (i) and (iii) of Sub-Clause 18.3 [Insurance Against Injury to Persons and Damage to Property].
17.2Contractor′s Care of the Works
The Contractor shall take full responsibility for the care of the Works and Goods the Commencement Date until the Taking-Over Certificate is issued (or is deemed to be issued under Sub-Clause 10.1 [Taking Over of the Works and Sections]) for the Works, when responsibility for the care of the Works shall pass to the Employer.
